Processing of personal data

pursuant to Regulation (EU) No 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter referred to as "GDPR")

I. ADMINISTRATOR

1) The controller of your personal data is the company VERTEX CZ, s.r.o, with registered office at Štramberská 1581/45a, 709 00 Ostrava, ID: 26804450, registered in the Commercial Register kept at the Regional Court in Ostrava, Section C, Insert 27360, (hereinafter referred to as the "Company").

3) The company has not appointed a data protection officer.

4) The processing of your personal data is carried out by the Company. The processing is carried out at its premises, branches and headquarters by individual authorised employees of the Company or by the processor. The processing is carried out by means of computer technology or, where applicable, manually for personal data in paper form, in compliance with all security principles for the management and processing of personal data. The Company makes every effort to ensure that your privacy is protected when using its services. The Company has taken technical and organizational measures to protect your data from loss, manipulation and unauthorized access. The Company continuously adapts its security measures in line with technological advances and developments.

II. PERSONAL DATA PROCESSED

1) You are under no obligation to provide personal data to the Company. However, the provision of your personal data is a requirement for the Company to enter into a contract with you. The Company only requires your personal data for the Company's purposes (for the reason, purpose and duration as detailed below). In no event will the personal information you provide be sold to other entities or used in any other commercial manner.

2) In particular, the Company processes your following personal data:

Name and surname
Address
E-mail address
Telephone
Bank account
Tax identification number and tax identification number (for an FO)
Data provided in excess of the relevant laws processed under your consent
3) The personal data processed will be obtained by the Company either directly from you (by you providing it, for example, as part of the registration for the service or from individual correspondence with you) or from publicly accessible registers, lists and records (e.g. commercial register, trade register, public telephone directory, etc.).

III. LAWFUL BASIS AND PURPOSE OF THE PROCESSING OF PERSONAL DATA

1) The personal data must be processed for the purpose of creating an offer, concluding a contract and fulfilling it, or maintaining the status of your customer account, and for the purpose of fulfilling related contractual or legal obligations, such as, in particular, archiving tax documents and handling any complaints. The lawful grounds for processing are therefore the performance of a contract (pursuant to Article 6(1)(b) of Regulation (EU) No. 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("GDPR")), the fulfilment of a legal obligation (pursuant to Article 6(1)(c) of the GDPR) and a legitimate interest (pursuant to Article 6(1)(f) of the GDPR).

2) The Company's legitimate interest (pursuant to Article 6(1)(f) of the GDPR) is also direct marketing, i.e. the Company also processes your personal data for the purpose of disseminating commercial communications relating to its own similar services, satisfaction questionnaires, sending you birthday or PF wishes, market news and to perform simple analytics (e.g. measuring website traffic, etc.). If your personal data is processed for this reason, you have the right to object to processing for direct marketing purposes.

3) If you have given your consent to the Company (e.g. in the context of competitions, marketing events, subscription to commercial communications, etc.), the Company processes your personal data on the basis of this consent (pursuant to Article 6(1)(a) GDPR). In the case of consent, the processing is carried out for the purpose of offering services, sending commercial communications and informing about the Company's events, etc.

IV. STORAGE PERIOD OF PERSONAL DATA

1) Your personal data will only be processed for the necessary period of time, which is determined by the performance of the contract and the subsequent storage of the tax documents for the ordered and delivered service. For reasons of legitimate interest, your information may be processed for a period of 3 years, but no longer than until you object to such processing.

2) If you give your consent, your personal data will be processed for a period of 3 years, but no longer than until you withdraw your consent to the processing of your personal data, which can be done in writing to the Company or by email to w.maslowski@vertexcz.cz

V. OTHER RECIPIENTS OF PERSONAL DATA

1) The processing of your personal data is carried out by the Company, i.e. the data controller, but personal data may also be processed for the Company by other persons, who may be:

Suppliers of external services to the Company (typically programming or other technical support services, server services, etc.),
Backup server operators or operators of technologies used by the Company who process it for the purpose of ensuring the functionality of the relevant services of the Company,
to the extent necessary, tax advisors, auditors, attorneys of the Company who process personal data for the purpose of providing consulting services,
personal data relating to debtors with overdue debts may also be disclosed to debt insurance companies or collection agencies for the purpose of collecting or recovering the Company's debts,
public authorities,
or other providers of similar services, but which are not currently used by the Company.
2) The Company does not intend to transfer your personal data to a third country (to a country outside the EU) or to an international organisation.

VI. YOUR RIGHTS

1) You have the right to:

  • Request information from the Company about what personal data it processes about you,
  • request an explanation from the Company regarding the processing of your personal data,
  • request access to your personal data from the Company and have it updated or corrected,
  • request that the Company erase your personal data or restrict its processing,
  • the portability of your personal data,
  • withdraw at any time the consent given to process your personal data,
  • object to the processing of your personal data for reasons of legitimate interest of the Company (Article III, paragraph 2)
  • in case of doubt about compliance with the obligations related to the processing of your personal data, to contact the Company or the Data Protection Authority.
